Are all types of divorce allowed in every state?
The two primary types of divorce are absolute and limited. A limited divorce is commonly known as a legal separation, and is only legal in certain states. A complete legal division, no matter the cause or process, is considered an absolute divorce and is legal throughout the United States. Some sub-types of divorce by states include:
• At-fault divorce: based on the grounds of one spouse's misconduct
toward the other
• Conversion divorce: from limited to absolute
• Default divorce: in the absence of one spouse
• No-fault divorce: no misconduct necessary, permitted in most states, standard in others
• Uncontested divorce.
